CONDITIONS OF SALE

 

PETRALIA PISTACCHI SOC. COOP. A R.L., with registered office in Piazza Cadorna n. 10, 95034 Bronte (CT), registered in the Catania Company Register REA no. CT- 400622, Owner of the site www.petraliapistacchi.com.

We wish to inform you that the Conditions of Sale reported below indicate in a clear and comprehensible way, the conditions and methods with which you can make your online purchases in the PETRALIA PISTACCHI SOC store. COOP. To R.L..

We therefore invite you to read and accept them in order to use all our online services quickly, safely and in full compliance with the principles of good faith and loyalty regarding commercial transactions.

 

Acceptance of the general conditions of sale

 

  1. The contract stipulated between PETRALIA PISTACCHI SOC. COOP. To R.L.e the Customer must be considered concluded with the acceptance, even if only partial, of the order by PETRALIA PISTACCHI SOC. COOP. To R.L. This acceptance is considered tacit, unless otherwise communicated to the customer in any way. By placing an order in the various ways provided, the customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the general and payment conditions transcribed below.
  2. If the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity), once the online purchase procedure has been completed, he will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of the laws in force in Italy on distance selling.
  3. Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damage to people and/or things, caused by non-acceptance, even partial, of an order.

 

Methodof purchase

 

  1. The Customer can only purchase the products present in the electronic catalog of PETRALIA PISTACCHI SOC. COOP. To R.L. when placing the order and viewable online at the address (URL) www.petraliapistacchi.com., as described in the relevant information sheets. It is understood that the image accompanying the descriptive sheet of a product may not be perfectly representative of its characteristics but may differ in colour, size, accessory products present in the figure.
  1. The correct receipt of the order is confirmed by PETRALIA PISTACCHI SOC. COOP. To R.L., through a response via e-mail, sent to the e-mail address communicated by the Customer. This confirmation message will contain the Date and Time of execution of the order and a "Customer Order Number", to be used in any further communication with PETRALIA PISTACCHI SOC. COOP. To R.L.. The message presents all the data entered by the Customer who undertakes to verify its correctness and promptly communicate any corrections, according to the methods described in this document.
  1. In case of non-acceptance of the order, PETRALIA PISTACCHI SOC. COOP. To R.L. guarantees timely communication to the Customer.

 

Methodof of payment

 

  1. Credit card (Convenient and secure means) – Our servers are protected by the SSL protocol and accurate encryption. At the time of payment you will be automatically connected to an interface and your data will be managed directly by the bank, PETRALIA PISTACCHI SOC. COOP. To R.L. he will never know about it. All this to maximize the security and privacy of our customers.

    7.1 In case of cancellation of the order, either by the Customer or in the case of non-acceptance of the same by PETRALIA PISTACCHI SOC. COOP. R.L. will be asked at the same time by the company itself to cancel the transaction and release the committed amount. The release times, for some types of cards, depend exclusively on the banking system and can extend up to their natural expiry (24th day from the authorization date). Once the transaction has been canceled, under no circumstances will PETRALIA PISTACCHI SOC. COOP. To R.L. may be held liable for any damages, direct or indirect, caused by delay in the failure to release the committed amount by the banking system.

    7.2 PETRALIA PISTACCHI SOC. COOP. A R.L. reserves the right to request from the Customer additional information (e.g. landline telephone number) or to send a copy of documents proving ownership of the Card used. In the absence of the required documentation, PETRALIA PISTACCHI SOC. COOP. To R.L. reserves the right not to accept the order.

    7.3 At no time during the purchase process PETRALIA PISTACCHI SOC. COOP. A R.L. is able to know the information relating to the buyer's credit card, transmitted via a secure connection directly to the website of the banking institution that manages the transaction. No computer archive of PETRALIA PISTACCHI SOC. COOP. A R.L. will retain such data. Under no circumstances will PETRALIA PISTACCHI SOC. COOP. To R.L. can therefore be held responsible for any fraudulent and improper use of credit cards by third parties, when paying for products purchased on PETRALIA PISTACCHI SOC. COOP. To R.L.
  1. Cash on delivery In case of purchase with Cash on Delivery, payment must be made exclusively with cash or CIRCULAR check made payable to the courier who will make the delivery. Nothing more than what is indicated at the time of the order will be due by the Customer.
    For orders coming from abroad with an amount exceeding 250.00 euros and for those coming from Italy with an amount exceeding 500.00 euros, it is not possible to accept cash on delivery as a payment method.

 

  1. Advance Bank Transfer In case of payment by advance bank transfer, the amount ordered by the Customer will be kept busy until receipt of proof of the transfer, to be sent to PETRALIA PISTACCHI SOC. COOP. To R.L. (via fax or e-mail) no later than 3 working days from the date of acceptance of the order. The order will be sent only when the sum due is actually credited to the current account of PETRALIA PISTACCHI SOC. COOP. To R.L. which must take place within 7 working days from the date of acceptance of the order. Once these deadlines have passed, the order will be considered automatically cancelled.
    The reason for the bank transfer must include:
    – the reference number of the order;
    – the date of placing the order;
    – name and surname of the order holder.

    Professionals/businesses who would like an invoice are asked to ask for one at the moment of the order by communicating the VAT number.

 

Prices

 

  1. Unless otherwise indicated in writing, all prices indicated for the products are "VAT included" and expressed in Euros. VAT will be added to the shipping costs. The validity of the prices indicated is always and only that indicated by the procedure (quote or cart) at the moment of forwarding the order to the Supplier. The prices of some or all products may in fact vary several times in the same day without the need for any notice.

 

Shipping methods

 

  1. The Company will organize the delivery of the Products to the address indicated by the Customer by means of selected professional transporters. Unless explicitly indicated by our Customer Service, delivery is at street level. Upon delivery of the goods by the courier, the Customer is required to check:
  • that the number of packages delivered corresponds to what is indicated in the transport document sent in advance via e-mail;
  • that the packaging is intact, not damaged, wet or otherwise altered, including the closing materials (adhesive tape or plastic straps);
  • the Customer acknowledges and accepts that in the event of impossibility of delivery of the Products due to his (or the person in charge) not being present at the time of delivery on the day and in the agreed time slot, the Products will not be canceled from the order and the relevant amount will not be credited back to the Customer.
  • To guarantee freshness, the shipment will start from the manufacturers' warehouses, consequently the customer will be able to receive multiple packages from each manufacturer relating to the products purchased

 

Complaints

 

  1. Any damage to the packaging and/or to the Products must be immediately contested by the Customer by placing a written control reservation on the Transporter's delivery document and specifying the reason for the reservation (for example, "Laundry packaging", "Tampered packaging"). For any anomalies found on the Products, other than those due to the physiological deterioration of the food products or the mere imperfection of the packaging, the Customer may contact the Company at the e-mail address: info@petraliapistacchi.com, specifying the defects found and documenting them with photographic material no later than 48 hours from receipt of the product, under penalty of forfeiture.

 

Shipping costs

  1. For orders in Italy and Europe, shipping costs are shown in weight ranges in the cart. Shipping costs may vary depending on the number of packages shipped and shipping is free for orders over €89 for food from the same manufacturer.

 

Invoice issuing

  1. At the time of purchase, the customer will receive a copy of the invoice in their email inbox.

 

Right of withdrawal

 

  1. Pursuant to art. 59, paragraph 1, letter. d) and e) of Legislative Decree 6 September 2005, n. 206 (Consumer Code), the right of withdrawal is excluded in relation to:
  2. a) Goods purchased by a customer who is not a consumer and/or who requests an invoice;
  3. b) Goods that risk deteriorating or expiring rapidly;
  4. c) Sealed goods that are not suitable for return for hygienic reasons or related to health protection and which have been opened after delivery.

With reference to the cases of exclusion of the right of withdrawal listed above, the Customer, in particular, is informed and accepts that the Products that "risk deteriorating or expiring rapidly" include all food products offered by PETRALIA PISTACCHI SOC. COOP. To R.L. on the Website, as the characteristics and qualities of these types of Products are subject to alteration also as a result of inappropriate storage.

 

RESPONSIBILITY

 

  1. PETRALIA PISTACCHI SOC. COOP. A R.L. undertakes to execute the Services in good faith and to fulfill, or ensure that they are fulfilled, with the utmost diligence all the obligations established herein in the spirit of solidarity and self-organization which characterizes and must characterize all the activities and services offered and used by Customers through the Website. PETRALIA PISTACCHI SOC. COOP. A R.L. will not be responsible for any delays occurring during transport. Likewise, the Company cannot be held responsible for any loss, damage, incorrect or non-delivery caused by events and/or causes of force majeure or unforeseeable circumstances, such as indicative but not limited to: natural disasters, adverse weather conditions (such as heavy snowfall), possible strikes (of its own or other employees), accidents to means of transport, explosions or any other cause, similar or different, which occurred outside the control of PETRALIA PISTACCHI SOC. COOP. To R.L. and not attributable to you, even if pre-existing, which prevents or aggravates the total or partial execution of the contract.

The Company will not be responsible for any damage resulting from inaccessibility to the Services resulting from problems connected to the network, providers or telephone and/or telematic connections over which it does not have control, or to the failure and/or defective functioning of the electronic equipment of the User or the Company's suppliers.

Privacy

 

  1. Pursuant to art. 13 of the legislative decree 06.30.2003 n. 196 (“personal data protection code”) PETRALIA PISTACCHI SOC. COOP. A R.L. declares that the Customer's data will not be disclosed and/or resold in any way to third parties and will be processed by the owner (PETRALIA PISTACCHI SOC. COOP. A R.L. – with headquarters in Piazza Cadorna n. 10 – 95034 Bronte (CT) for the sole purpose of sending you our commercial offers that will reflect your interests, to manage your request to register on the site and for processing purposes of the order.

 

The data may also be processed by third parties (for example, Internet Providers, commercial and marketing services) for activities instrumental to the provision of services reserved for registered users.

Subject to consent, the data may be communicated to third-party companies with the same purposes in the sectors: commercial and marketing services.

Personal Data may be directly provided by the Customer or, in the case of Usage Data, collected automatically during the use of this Application.

Unless otherwise specified, all Data requested by this Application is mandatory. If the Customer refuses to communicate them, it may be impossible for this Application to provide the Service. In cases where this Application indicates some Data as optional, Customers are free to refrain from communicating such Data, without this having any consequence on the availability of the Service or its operation.

 

Place

 

  1. The Data is processed at the Owner's operational offices and in any other place where the parties involved in the processing are located. The Customer's Personal Data may be transferred to a country other than the one in which the customer is located, even outside the European Union.

When such a transfer occurs, we ensure that it is carried out in accordance with this Privacy Policy and provides adequate protection. If one of the transfers just described takes place, the Customer can refer to the respective sections of this document or request information from the Owner by contacting him at the details indicated at the beginning.

 

Shelf life

 

The Data are processed and stored for the time required by the purposes for which they were collected, after the complete order has been processed they will be deleted within one year from that moment.

The following categories of data may be retained for additional periods:

  • Financial and accounting data (e.g. invoices, payments, refunds, etc.) are retained for the duration required by applicable tax and accounting laws;
  • all user-generated content (e.g. purchased products, behavior patterns) is anonymized, but remains available for our analyzes in an aggregate manner.

 

At the end of the retention period, the Personal Data will be deleted. Therefore, upon expiry of this deadline, the right of access, cancellation, rectification and the right to data portability can no longer be exercised.

Pursuant to art. 7, d. Legislative Decree 196/2003 the customer/user has the right to exercise some rights including knowing:

– the origin of the personal data;

– updating and rectification or, if interested, integration of data;

– the purpose and method of processing;

– the identification details of the owner and manager;

– the cancellation, transformation into anonymous form or blocking of data processed in violation of the law.

Applicable law

 

  1. The sales contract between the Customer and PETRALIA PISTACCHI SOC. COOP. To R.L. is intended to be concluded in Italy and regulated by Italian law.

For the resolution of civil and criminal disputes arising from the conclusion of this distance selling contract, the territorial jurisdiction is that of the territorial jurisdiction of the registered office of PETRALIA PISTACCHI SOC. COOP. To R.L. and therefore the Forum of Catania.

 

Pursuant to and for the purposes of the articles. 1341–1342 cod. civil, the parties declare to have read and understood, and therefore to expressly approve the Articles: 3 order acceptance; 7.1 order cancellation; 7.3 additional credit card information and fraudulent and improper use of the same by third parties; 11 delivery times; 12 customer liability for non-delivery in case of absence; 12 complaints; 15 exclusion of the right of withdrawal; 16 exclusion of liability for transport delays, force majeure, unforeseeable circumstances and inaccessibility to the network; 20 applicable legislation and competent court.

With the release of its definitive authorization for Registration, therefore, the Customer fully and explicitly approves, without any reservation, the aforementioned clauses identified in the previous paragraph.
